AG: Wackenhut Given Improper Raises.(New Mexico)

SANTA FE The Corrections Department exceeded its authority in giving a private prison company a retroactive pay raise for jailing New Mexico prisoners, the attorney general said Friday.

"The Corrections Department has contractual authority to provide only for prospective payment adjustments," Assistant Attorney General Zachary Shandler said in an advisory letter to the Legislative Finance Committee. "It does not have the authority to provide for retroactive payment adjustments."

At issue was Corrections Secretary Rob Perry's decision in March to give Wackenhut Corrections Corp. a 5 percent increase in payments retroactive to July 1, 1999, for jailing state inmates. …
