Builder Says He Was Unaware of EPA Visit

The case of a West Side home builder accused of not telling customers about pollutants under or near homes he was selling has gone to a District Court jury.

Last week, Richard Fuller of Richard Fuller Homes Inc. testified he didn't think it was necessary to tell customers what he knew about the contamination.

Fuller is accused of fraud and unfair trade practices in a civil lawsuit filed in 2nd Judicial District Court in 1997.

The lawsuit says Fuller knew about a plume of contaminated groundwater near or under some home sites at Cactus Pointe a subdivision on Albuquerque's West Side but said nothing to customers. …
