The preliminary-hearing testimony of a man convicted of second-degree murder in two 1995 homicides at a Torreon cabin will be allowed at the retrial of a co-defendant in the case.

State District Court Judge Neil Mertz ruled Aug. 24 that the preliminary hearing testimony of Shawn Popeleski will be permitted at the trial of co-defendant Shaun Wilkins.

Wilkins is charged with first-degree murder in the deaths of Ben Anaya Jr., his girlfriend, Cassandra Sedillo, and Sedillo's two young sons, Matthew Garcia and Johnny Ray Garcia.

Wilkins' first trial in 1997 ended in a hung jury. A date has not been set for a retrial. …
