Appeals Court Outcome Must Wait for Recount.(Metro & New Mexico)


A close three-way race for the Position 3 seat on the state Court of Appeals remained in limbo Wednesday because of a software problem that caused the recount of tens of thousands of votes in Bernalillo County.

Democrat Ira Robinson held a 46 percent to 43 percent lead over T. Glenn Ellington with 99 percent of precincts reporting as of Wednesday. Green candidate Marvin H. Gladstone pulled in 12 percent.

Ellington was appointed to the court by Gov. Gary Johnson.

County spokeswoman Liz Hamm said the nearly 67,000 absentee and early-voting ballots would be recounted today. …
