Judges Find No Crime Connection

Two shoe boxes full of money have been relinquished by the Tucumcari Police Department and returned to their owner after the state Court of Appeals said there was no evidence the bills were part of a drug transaction.

The shoe boxes and the currency which totaled $104,999 were found in the trunk of a car stopped in Tucumcari for a traffic violation.

The police department believed the money was the result of a drug-related crime and subject to forfeiture.

A part of the New Mexico Controlled Substances Act says property subject to forfeiture includes "narcotics paraphernalia or money which is fruit or instrumentality of the crime. …
