Court Asked To Silence Schaefer on PNM.(Business)

City, Two Groups Petition Justices

What began as a war of words over a perceived conflict of interest involving Public Regulation Commissioner Tony Schaefer and PNM has escalated into a legal matter before the state Supreme Court.

On Friday, lawyers for the city of Albuquerque and two other organizations filed a petition in the court seeking to block Schaefer, a commissioner from Las Cruces, from voting on any future matters involving Public Service Company of New Mexico or Vulcan Power, another utility business.

Schaefer has a conflict because he received lodging while in Santa Fe on commission business from a lawyer representing PNM and Vulcan on matters before the PRC, according to a petition filed by the city of Albuquerque, the New Mexico Industrial Energy Consumers and U.S. Executive Agencies.

Schaefer in July said he would recuse himself from matters involving PNM and any other cases in which the Santa Fe lawyer, David Cohen, was or might be involved. …
