Ruling in Radio-Tower Dispute Delayed.

A state District Court judge postponed ruling Monday in a legal dispute among an East Mountains ham radio operator, his neighbors and Bernalillo County.

District Judge Wendy York said she needed time to review materials submitted by plaintiff Gerald L. Smith, defendant Bernalillo County and a group of residents who intervened in the lawsuit.

The lawsuit targets two 140-foot ham-radio antenna towers Smith erected on his property on Crestview Lane, about 2.6 miles north of old Route 66 off Mountain Valley Road.

"The principal issue is whether Mr. Smith's amateur radio antennas are allowed in the (agricultural) zone where he lives," Smith's attorney, David Campbell, said at a hearing Monday. …
