Suit Challenges Height Standards

A district judge on Friday refused to declare unconstitutional a Bernalillo County law that says light poles can't be taller than 16 feet.

Michael Foote, who operates a sports complex in North Albuquerque Acres, has sued Bernalillo County alleging the law was written to put him out of business.

The suit might get to trial in the spring, attorneys said, but meanwhile they had asked District Judge William Lang to stop the county from enforcing the ordinance. Lang denied their motion.

Attorneys for Foote and his former partner, John D'Antonio Jr., said they would ask for a court order putting enforcement on hold until a jury decides whether the light law is "rational. …
