State Not Reporting Malpractice Amounts

The state has paid an estimated $35 million in malpractice payments since 1998 for children treated for cancer at University of New Mexico Hospital.

But neither UNM nor the state Risk Management Division, which has paid the money on behalf of the school, has reported the payments to the New Mexico Board of Medical Examiners or to a national data bank on physicians.

G.T.S. Khalsa, general counsel for the Board of Medical Examiners, contends UNM and Risk Management are required by state law to report malpractice payments to the board.

The medical board needs such information to ensure physicians are disciplined or receive more training when warranted, Khalsa said. …
