Exception to Tower Height Limit Denied

A Delaware telecommunications firm is suing Santa Fe County over its recent refusal to allow cellular antennas to be placed atop a La Cienega tower.

The suit, filed Dec. 14 in U.S. District Court in Albuquerque, alleges county commissioners violated the federal Telecommunications Act of 1996 in rejecting an exception request to local height regulations for American Tower Corp.

The case was filed in the court of District Judge Lorenzo Garcia.

The company, which owns a 150-foot-high tower in La Cienega, has an agreement with AT&T Wireless Services Inc. to lease space on the tower. …
