Court Won't Limit Schaefer.(Business)

The state Supreme Court has denied a petition to have Public Regulation Commissioner Tony Schaefer disqualified from participating in cases relating to Public Service Company of New Mexico.

Schaefer admitted in July that he had stayed overnight numerous times at the Santa Fe home of David Cohen, a lawyer who has represented PNM.

The city of Albuquerque, New Mexico Industrial Energy Consumers and U.S. Executive Agencies questioned whether the arrangement affected his impartiality in commission cases involving PNM and Vulcan Power, a geothermal company in which Cohen has an interest.

Schaefer then wrote a letter July 18 to fellow commissioners and the various groups saying "the only appropriate action now is to recuse myself from all cases involving PNM, Vulcan Power, and other cases in which the Cohen law firm has participated. …
