* One suspect convicted of criminal sexual contact in incident at UNM frat house

Eduardo Garcia, a 22-year-old Sigma Alpha Epsilon fraternity member from El Paso, was acquitted Thursday of rape and four other counts in an October 1998 incident involving an 18-year-old University of New Mexico freshman.

Garcia's fellow SAE member and co-defendant, 21-year-old Victor Hernandez, also of El Paso, was found guilty of one count of criminal sexual contact for touching the unclothed buttocks of the female student while she was "unconscious or physically helpless."

But Hernandez also was acquitted of the far more serious charge of rape, as well as conspiracy to commit rape and another count of criminal sexual contact. …
