Firm Appeals Denial By County of Permit

The same conditional-use permit required to open the doors of a new church in rural San Miguel County is issued for the installation of cell phone towers, including a controversial new 240-foot tower between Rowe and Pecos.

The county lacks guidelines that would allow cell phone towers and residents to abide in peaceful co-existence, said Jesus Lopez, an attorney for the county.

"Our position is simply that we have nothing on the books. We're acting in the dark, without rules and regulations," Lopez said.

Turmoil over the tower near Pecos, and a growing number of towers in San Miguel County, has led county commissioners to reconsider whether silence is golden when it comes to cell phone towers.

The county, a Florida-based company called SBA Towers, and residents around the tower near Interstate 25 and the Pecos National Historical Monument have been embroiled in a dispute over the location of SBA's latest installation. …
