Victim's Pal on Trial In New Year's Slaying

The man who shot Alex "Cricket" Moya outside a Santa Fe gas station on New Year's Eve 1999 is still on the loose, defense attorney Dan Marlowe said in court Thursday.

Marlowe said police pressured Moya's girlfriend, Christine Tapia, to say she saw the man charged in Moya's death, Wilfred "Waco" Martinez, pull out a gun and accidentally shoot Moya while fighting with another man. Martinez's trial began Thursday.

Marlowe insisted in court that his client, now charged with second-degree murder, was never armed.

"They basically prevailed upon her to put the gun in my client's hand," Marlowe said. …
