Jury Deadlocks On Second Drug Charge

An Albuquerque man was convicted of conspiracy to commit drug trafficking Thursday, but a Sandoval County jury could not reach a verdict on a charge of trafficking by possession with intent to distribute.

Thirteenth District Judge Louis P. McDonald declared a mistrial on the trafficking charge, but it can be refiled, according to Assistant District Attorney David Waymire.

Nine jurors wanted to convict Basilio Rojo-Alderet on the trafficking by possession charge, two jurors wanted to acquit and one was undecided, Waymire said Thursday.

Waymire, who prosecuted the two-day jury trial this week, said he does not know whether he will refile the charge. …
