Clarification About Secret Votes Sought

Santa Fe's City Council on Wednesday was unable to perform its state-mandated annual duty to agree to abide by the State Open Meetings Act.

Failing on a 4-2 vote, the resolution an annual rite would have affirmed the local government's commitment to adhere to the state law that says when bodies such as the council can meet outside the public eye. Five votes were needed to approve the resolution.

Councilors Frank Montano and Miguel Chavez cast "nay" votes, but apparently not because they object to the Open Meetings Act. Montano said he wanted to have the city Ethics and Rules Committee, which he chairs, first clarify whether the council could take votes on pending legal action behind closed doors in what is known as executive session. …
