Officer Indicted on Battery Charges.(Metro & New Mexico)

An Albuquerque police officer who allegedly beat a handcuffed suspect with a baton was indicted Tuesday by a Bernalillo County grand jury on charges of aggravated battery with a deadly weapon, Deputy District Attorney Julie Altweis said.

The officer, Tom Benard, is not in custody but was required to turn in his badge and gun pending the outcome of the almost year-old investigation. He was transferred to the APD telephone reporting unit, a police spokeswoman said last week.

Altweis said after the grand jury adjourned that the indictment would be formally filed today in district court. Aggravated battery is punishable by up to three years in prison; a year can be added if a judge finds aggravating circumstances. …
