Nuisance Law Needs Careful Consideration.(Editorial Page)


The City Council is considering replacing Albuquerque's public-nuisance law which now includes prostitution, drug activity, gambling and underage drinking with a much broader ordinance that attempts to eliminate centers for many more types of unpleasant, illegal behavior.

A proposal by Councilor Adele Hundley would add such offenses as receiving stolen property, assault on a peace officer, dog fighting, sexual exploitation of children and the nebulous-but-ubiquitous gang activity to the reasons for which the city could take away someone's home or business.

It seems that in today's uncivil world, many cities are leaning toward the big stick of property confiscation to make people behave. …
