Calls Violated Her Rights, She Claims

Santa Fe Police Sgt. Jerry Archuleta, who escaped criminal prosecution in 1999 after being investigated for harassment, is now being sued in U.S. District Court.

Candice Tometich, who was 18 when then-Lt. Archuleta pulled her over on a traffic stop in March 1999, is alleging the officer violated her Fourth and 14th Amendment Constitutional rights by making an "unreasonable" stop and making subsequent telephone calls and visits.

The lawsuit, filed Friday, also names the city of Santa Fe.

City Attorney Peter Dwyer, who declined to comment on the merits of the pending case, said Archuleta will be provided legal protection for his actions in his official capacity. …
