Charges Dismissed In Cross Burning.(Final)

Criminal charges were dismissed Wednesday against former Kirtland Air Force Sgt. Andrew McDaniel, who was accused of burning a 5-foot tall wooden cross in his back yard in March.

Metropolitan Court Judge Wayne Griego dismissed four misdemeanor charges against McDaniel, said his lawyer Lara Hague.

In April, McDaniel, 24, pleaded not guilty to negligent use of firearms, unlawful assembly, disorderly conduct and helping minors buy alcohol.

"The judge dismissed the charges because the state failed to provide a proper witness list, for one," said Hague. "Had this case gone to trial, I think everyone would have seen how this was a total misunderstanding. …
