An Energy Department rule that could have allowed high-level radioactive sludge to be sent to a New Mexico waste dump is illegal, a federal court ruled this week.

The ruling blocks a DOE attempt to reclassify the high-level waste, which would have allowed the agency to leave it buried at nuclear weapons factory sites around the country or send it to the Waste Isolation Pilot Plant near Carlsbad.

The federal government currently has nowhere to dispose of high-level nuclear waste, creating a problem for cleaning up nuclear weapons factory sites like Hanford in Washington state. …
