New state policies affecting gays and lesbians, which many citizens would argue have taken far too long, already are encountering problems.

Given the controversy, politicians tend to handle such issues with kid gloves so they alienate as few constituents as possible. That special handling leads to its own set of problems.

Making good on a campaign promise, Gov. Bill Richardson in April signed an executive order extending employment benefits, such as health insurance coverage, to domestic partners of state employees. Richardson also promised to uphold the state constitution, but this exceeds the governor's constitutional authority.

That's what Senate Minority Leader Stuart Ingle argues in a letter seeking an opinion from Attorney General Patricia Madrid. …
