Man Will Likely Face Retrial in Baby's Death.(Final)

A man convicted for his role in the beating death of his 1-year-old stepson will likely see a new day in court.

The New Mexico Court of Appeals reversed the conviction of Hugo Cortez, a Mexican citizen, this month because the court determined that the jurors were not given the proper definitions of "negligence" and "reckless disregard" in Cortez's 2001 trial.

The jury found Cortez guilty of child abuse by negligently permitting death or great bodily harm to Kevin Cortez in 1996.

The defense maintained that Kevin's injuries were accidental. The medical examiner, however, testified Kevin died of battered-baby syndrome. …
