A June 2002 confrontation with his ex-wife led to felony charges Friday against Bernalillo County Metro Court administrator Toby Martinez.

Martinez, 41, was indicted by a grand jury late Friday on a charge of aggravated battery on a household member with great bodily injury. The indictment alleges he punched Annette Wihl in the face and head with his fists and shoved her into a stucco wall at her Northeast Heights residence.

Prosecutors said months ago that felony charges were under consideration because of the extent of Wihl's injuries.

Martinez's attorney, Billy Blackburn, said his client is innocent and predicted he would be exonerated at trial once a jury has an opportunity to "hear all of the positive testimony concerning Toby Martinez's innocence as well as testimony about the alleged victim's character, psychological history and mental instability. …
