Mayor Could Ask Appellate Judges To Reconsider Issue

Mayor Martin Chavez said Thursday he will seek further consideration by the 10th Circuit Court of Appeals on a case that could take Albuquerque water to help the silvery minnow.

A three-judge panel of the court ruled against Albuquerque last week, upholding an earlier decision that said federal water managers can take water from cities and farmers, who have contracted for it, when the water is needed to help the Rio Grande minnow.

Chavez spoke with reporters Thursday at a news conference at Heron Lake in northern New Mexico, where the city stores water that has been diverted from Colorado through the San Juan-Chama project. …
