City Vendor Says Pact Is Illegal

The Santa Fe City Council's program to buy rain barrels and sell them to city residents at a loss violates the New Mexico Constitution, a local rain barrel vendor contends in a formal protest filed Wednesday.

The subsidized rain barrel program -- intended as a water conservation measure -- contravenes the state constitution's "anti-donation" clause that bars cities from making "donations to or aid in favor of any person," says the protest filed by Creative Environments Santa Fe Inc.

The 1,250 rain barrels the council recently agreed to buy from a Massachusetts company for $98,662 will be sold to residents for about $40, about $40 less than the city's cost per barrel. …
