A teen who shot and killed a 16-year-old boy outside a Santa Fe apartment complex during a gang-related brawl on Mother's Day committed justifiable homicide when he fired the gun to protect a friend who had been stabbed, his attorney said Friday.

Phillip Herrera, 19, has admitted fatally shooting Anthony Jaramillo, 16, in the chest May 11 but said he did so only because Jaramillo was about to hit one of his friends with a rock, court records state.

Defense of a third party "is all over the place here," Herrera's attorney Dan Marlowe said of his client's actions in the shooting.

"I think that we're out of the murder ballpark, or I hope so anyway," Marlowe said. …
