Scientists' Group Appeals Decision

SANTA FE -- The Justice Department is refusing to make public a report on its investigation of Wen Ho Lee, the fired Los Alamos National Laboratory nuclear scientist whose prosecution provoked an apology from a federal judge.

The DOJ last week rejected a Freedom of Information Act request for the report filed by the Federation of American Scientists.

Marlene Wahowiak, assistant counsel for freedom of information in Justice's Office of Professional Responsibility, responded in a May 29 letter that the Lee report "should be withheld in its entirety."

Wahowiak cited exemptions to the Freedom of Information Act involving national security, personal privacy and law enforcement records. …
