Delay Means Suspect Will Probably Go Free

The charges against a suspect in a drunken driving case that resulted in severe injuries to the victim will probably be dismissed today because the state failed to prosecute the case in a timely manner.

It would be the second DWI charge the suspect, Jose Munoz, has had dismissed.

In this case, Munoz was accused of rear-ending motorcyclist Paul Chalker in October while Munoz was driving his Jeep with a 4-year-old passenger, police reports said.

Charges against Munoz included aggravated DWI and endangering a child, reports said.

Alesia Duran, the assistant district attorney prosecuting the case, said that today the case will be dismissed because it was not prosecuted within the state mandated six-month time period. …
