Man Convicted in Killing Going Home.(Final)

After four years in prison on a murder conviction whose validity has been undermined, Charles McClaugherty is going home.

District Court Judge Neil Candelaria, who threw out McClaugherty's conviction earlier this month because of prosecutorial misconduct, signed off Wednesday on conditions of his release, pending an appeal by prosecutors, his attorney said.

The conditions include maintaining employment or enrolling as a full-time student, staying away from witnesses in the case and not leaving the state without the court's permission.

McClaugherty, 22, has been in custody since his arrest in June 1999 in the shooting death of Ricky Solis. …
