No Legal Barrier In Petroglyph Case

Albuquerque city councilors narrowly approved a legal opinion Monday needed before work can begin on a four-lane roadway through the Petroglyph National Monument.

The council voted 5-4 in favor of a one-sentence opinion from City Attorney Bob White saying that "no credible legal barrier exists" to constructing Unser and Paseo del Norte through the monument.

"Obviously, anybody can sue anybody," said City Councilor Michael Cadigan, who urged support for the opinion. "But there is not a credible legal barrier" to the road projects.

Still, further approvals, such as construction agreements, are required from the council before construction actually starts. …
