EU Court rules European bilaterals illegal. (News Briefs).(European Court of Justice declares open skies agreements illegal)

European Court of Justice on Nov. 5, as expected, ruled that eight European Union member states broke the law when they signed open skies agreements with the US. However, the court also said that EU law does not necessarily give the European Commission the right to negotiate air transport deals, stating that there is "no express external Community competence in that regard," although it added that competence "may result by implication from the Treaty [of Rome]." It also found that "certain aspects of the establishment of fares and rates on intra-Community routes, applicable to non-Community carriers, and the commitments in regards to [CRSs]" are within the EC's authority.
