Mesa Air Group, which is a defendant in a $173 million lawsuit brought by Hawaiian Airlines over Mesa's entry into the Hawaiian inter-island market, was dealt a significant legal setback in late September after a US Bankruptcy Court judge affirmed in a pre-trial ruling Hawaiian's accusation that Mesa misused confidential information obtained from HA when it was considering investing in the bankrupt airline. Mesa ultimately chose not to invest and instead launched go! to compete against HA and Aloha Airlines. Misuse of the confidential data "was a substantial factor in Mesa's decision to enter the Hawaii market," Judge Robert Faris ruled.

The judge also ruled that Mesa CFO Peter Murnane destroyed computer files relevant to the case. …
